Client charged with Driving While Suspended in KS after being stopped for no seat belt. Client's driver's license suspended due to DUI and breath test over 0.15%. After extensive negotiating with the prosecutor over the legality of the stop, prosecutor agreed to amend the DWS charge to Illegal Parking and in doing so, client avoided a revocation of probation on the DUI case in other jurisdiction. DWS charges often follow a DUI suspension and the client becomes entangled in the "suspension" web. The best way to avoid this situation is to contact an attorney who understands the Kansas and Missouri license suspension laws and can help you apply for a restricted (hardship) Permit. Obtaining a restricted Permit may not be as hard as you think. I have had success getting restricted or "limited" driving permits for clients who otherwise would remain suspended for months until they resolve their pending tickets.
