MIP case dismissed before trial

Client, E.E., was charged with Minor in Possession following a dispute with her roommate in a small southeast Kansas town. The police were called due to the domestic disturbance wherein my client was threatened by her roommate. Upon arrival, the police requested breath tests from all parties at the scene. My underage client tested at 0.05%, an amount over the legal for under 21 drinkers. I was able to convince the prosecutor to dismiss the charge since my client was the alleged victim in the underlying domestic dispute complaint. The domestic case filed against the roommate is still pending. Regardless, I was able to highlight my client's proper conduct during the altercation and the prosecutor rewarded her by dismissing the MIP charge. She did complete a typical underage drinking class in advance of my request to dismiss. This clearly made an impact. No probation, no conviction.
