Missouri DWI Dismissed before trial
October 2016
St. Charles County vs. TC: Vietnam veteran charged with DWI and failure to maintain a single lane in St. Louis in 2005. Client failed to appear in court for 10 years. Facts: client refused field sobriety testing at the scene in part because of physical limitations from injuries sustained as a US soldier during a tour in Vietnam. His arrest was based on odor of alcohol and blood shot eyes only. He refused the breathalyzer at the station. He was otherwise cooperative with law enforcement. Client returned to hometown in Kansas and does not respond to the charges until 2016, several years after his arrest. After discussions with the prosecutor and after client had completed the required alcohol educational courses required by the Missouri DMV, the charges were dismissed pretrial. No probation and no conviction reported on his record.
