DWI amended to Defective Equipment for small fine

Client charged with DWI after being found sleeping in his car at an intersection in Missouri; Client took field sobriety tests and did well; he refused the Preliminary Breath test (PBT) and was placed under arrest. He was otherwise cooperative with police. At the station he refused the breath test. He was charged with DWI and Open Container after two empty bottles were found in his. I was able to get the DWI amended to Defective Equipment and the open container charge amended to Littering. The client used his bond to pay the fines of $550. No probation ordered. Client applying for citizenship status in the US and therefore avoided some of the complications that would have occurred with a plea of guilty to the DWI. I used the facts of the case, namely his good performance on the field testing, as well as the officer's missteps in the arrest process in achieving a very favorable plea agreement. The client was happy and can proceed with his citizenship application with a clear conscience.
