An SIS (suspended imposition of sentence) result on a Missouri DWI are not supposed to get reported to the Kansas DOR, right? Well, those days are over. Kansas Department of Revenue has now started recording SIS results from Missouri DWI case on your Kansas driving record. This, of course, is not what you were told by your Missouri lawyer. The lawyer likely is not aware of the new policy in Kansas that allows for the recording of ALL cases and suspensions in Missouri dealing with alcohol offenses. This creates confusion and anger and that is understandable. Your lawyer will need to contact the KS Dept. of Revenue, driver's license offices, and submit proof of the SIS on the Missouri case. This will trigger the state to remove the conviction, but you must submit the court documents from the DWI case. Only in the past year has this become an issue for Kansas drivers. Kansas recently updated their systems to comply with federal regulations to have convictions transferred between all states electronically. Shortly after these enhancements were implemented, the DMV was made aware the convictions from Missouri do not state if it's been put on an SIS; instead, those are being reported to Kansas as a conviction, meaning the driver was found guilty; therefore, the conviction is put on the record and action is taken. This action includes likely suspension of their license. At this time, the only way to amend the action is to send the documentation proving the specific conviction was meant to be an SIS, i.e. suspended sentence.
