Felony DUI dismissed at preliminary hearing due to absence of material witness

Client charged with felony DUI following a car stop for a lane violation. Client consented to a blood draw that resulted in a 0.102 BAC. The RN who drew the blood was required to appear at a preliminary hearing in order to testify about the blood process and her credentials to draw blood. She was unavailable to testify on two separate occasions and the state elected to dismiss the charges. Client looked good enough on video during his field testing that the state decided to drop the charges. Read On
